A former employee of Trece Mexican Restaurant has filed suit against its three operating companies and two individuals who control the business over claims that they violated state and federal labor laws. The man says he worked for the defendants as a dishwasher and porter, typically putting in about 68 to 74 hours of work per week. He was allegedly paid a fixed weekly salary that didn’t include time-and-a-half premium wages for the hours he worked above 40 each week and spread-of-hours pay for shifts that lasted longer than 10 hours. According to the complaint, the plaintiff is owed a total of $312 in unpaid wages.
The suit further alleges that the plaintiff and other restaurant employees were not provided with proper meal breaks or wage statements. On top of that, the plaintiff says he was required to purchase “tools of the trade,” including pants and shoes, without being reimbursed.
