A Transfield Services employee has filed suit over claims that the oil refinery operator violated federal and state labor laws by not paying proper wages.

A Transfield Services employee has filed suit over claims that the California-based oil refinery operator violated federal and state labor laws by not paying proper wages.
The plaintiff put in 10- to 12-hour workdays at the company as a safety attendant responsible for handling potential hazards at work sites, the suit says. The man alleges he was required to perform a substantial amount of off-the-clock work, including receiving physical examinations, participating in training sessions and obtaining certifications. Additionally, the case claims workers similarly situated to the plaintiff regularly performed 30 minutes of pre-shift activities each day, such as gathering tools, putting on gear and traveling to their assigned workstations. The plaintiff says he was not paid for all time worked, nor premiums owed for missed breaks, due to the defendant’s policy of compensating employees only for work performed after arriving at refinery sites.
All told, the lawsuit says, the plaintiff was denied not only overtime and double-time wages, but was also deprived of proper break periods and reimbursements for work-related travel and protective equipment expenses.
