Trademark Construction Facing Former Employee’s Wage and Hour Lawsuit

The plaintiff in a proposed class action filed against Trademark Construction Co., Inc. and a company that does business in California as J.M.W. Truss and Components claims the companies committed violations of state labor law.

Trademark Construction Co., Inc. and a company that does business in California as J.M.W. Truss and Components have been named as defendants in a former employee’s proposed class action lawsuit. The plaintiff, who worked for the defendants as a carpenter and safety coordinator, claims his former employers violated state labor law in that they failed to:
- compensate employees at least the minimum hourly wage for all hours worked;
- required them to work off-the-clock;
- rounded down their reported hours;
- pay proper overtime wages for hours worked over 40 in a week;
- provide premium pay for hours worked in excess of 8 in a day;
- provide 10-minute rest periods for every four hours worked;
- reimburse employees for expenses associated with using cell phones or personal vehicles for business purposes and purchasing necessary equipment; and
- provide accurate wage statements.
The plaintiff claims he generally worked nine- to 12- hour shifts five or six days per week without receiving proper wages.
Originally filed in state court, the lawsuit has since been removed to California federal court.
