Paladin Towing & Recovery Inc. and an individual owner have been named as defendants in a proposed class and collective action that accuses the parties of failing to pay tow truck drivers proper overtime pay. The plaintiff claims he and other drivers were paid a $40.00 commission for each towed vehicle but were denied premium wages for the hours they worked over 40 each week. The case claims employees would often put in more than 100 hours per week and didn’t fall under any Fair Labor Standards Act exemptions, meaning they should have received one and one-half times their “regular rate of pay” for all hours worked over 40.
