A former Top Choice Home Care employee has filed a proposed collective action in which she seeks to recover allegedly unpaid overtime wages.

The lawsuit states the plaintiff worked as a home care provider out of Philadelphia for the company from February 2015 to September 2018. During her tenure, the woman was paid $13 an hour for all time worked, including for overtime hours for which she should have been compensated at a time-and-a-half rate, the suit claims. The case adds that the company, despite requiring the plaintiff to log her work hours, knowingly failed to pay proper wages “as a matter of policy.”
