A wage and hour lawsuit filed in March 2018 against Kaiser Foundation Health Plan, Inc., Kaiser Foundation Hospitals and Southern California Permanente Medical Group has been removed to federal court in California.
Behind the suit are four employees who say they worked as “time system coordinators” out of a Corona, California call center. According to the complaint, the plaintiffs’ job duties consisted of taking “a high volume” of phone calls, performing data entry related to the defendants’ payroll, and processing pay period adjustments.
The plaintiffs allege they were wrongly classified as exempt from overtime pay and consequently worked between 15 and 30 overtime hours each week without receiving time-and-a-half wages. The workers further claim that, in violation of state law, they did not receive premium pay for shifts exceeding 12 hours.
The case goes on to allege the employees were “micromanaged” and deprived of uninterrupted meal and rest breaks. From the complaint:
“Plaintiffs and the other Timekeeping Coordinators are required to be at their desk at all times during their scheduled shifts. If Plaintiffs are not on calls during their scheduled hours for more than ten to fifteen (10-15) minutes, a manager will ‘ping’ the employee (through Skype) to determine why they are not on the phone.”
