A proposed class action case has been filed in Florida against Miami Beach restaurant operators Sugar Factory Ocean Drive LLC; Down and Dirty Tacos & Tequila Bar Ocean Drive LLC; and Shared Services Florida LLC over alleged Fair Labor Standards Act (FLSA) abuses. The plaintiff claims he worked 60 hours per week for the joint employer defendants from December 2015 through October 2016 without bona fide lunch breaks or time-and-a-half overtime premiums for each hour worked beyond 40. The complaint notes the plaintiff was “in disagreement with his paycheck and complained about the missing overtime payment” many times, eventually deciding to leave his job in October 2016 with no remedy to the situation.
