A proposed class action lawsuit has been filed against the operators of three Crunch Fitness centers in southwest Florida over an allegedly unlawful pay practice that the case says has cheated workers out of overtime wages.

A proposed class action lawsuit has been filed against the operators of three Crunch Fitness centers in southwest Florida over an allegedly unlawful pay practice that the case says has cheated workers out of overtime wages.
The plaintiff in the case says he worked as a maintenance employee at the defendants’ Bonita Springs, Ft. Myers, and Naples locations between May 2015 and February 2018 without receiving proper time-and-a-half overtime pay. According to the lawsuit, the alleged overtime violations stem from the defendants’ “failure to consider all hours worked cumulatively” at all Crunch Fitness locations during each pay period. The case points out that each fitness center is run by the same management, has the same owners, and operates in the same way as the others. The plaintiff argues that he therefore should have been paid premium wages for the hours he worked above 40 each week at all three locations.
