The Habitat Company of Alabama, LLC and The Habitat Company LLC are defendants in the second proposed collective action filed against them this week accusing them of misclassifying employees as exempt from overtime wages.

The Habitat Company of Alabama, LLC and The Habitat Company LLC are defendants in the second proposed collective action filed against them this week out of Alabama. The property management companies have been accused of misclassifying their employees as exempt from overtime wages.
The suit alleges the plaintiff and similarly situated employees were hired by the defendants in November 2015. They were allegedly paid a “salary” and forced to work between 60 and 70 hours per week without being paid time-and-a-half overtime wages for the hours they worked above 40. The plaintiff says his previous employer, who managed the properties he worked on before the defendants took over, properly classified him as a non-exempt employee and paid him an hourly wage, plus overtime when applicable.
Furthermore, the suit claims the defendants revised their policy at some point during the plaintiff’s employment and began paying him by the hour to comply with the Fair Labor Standards Act. He argues, however, that they allegedly owe him and other employees unpaid overtime wages for the time they spent working as exempt employees.
