A proposed class and collective action has been filed against The Cheesecake Factory Restaurant, Inc. over allegations that front-of-the-house tipped employees—servers, bussers, food runners and bartenders—at the company’s Annapolis, Maryland location have not been paid proper minimum and overtime wages. The plaintiff, who worked for the defendant from April 2014 through November 2016, alleges the Cheesecake Factory engaged in the practice of shaving the number of hours tipped employees worked each week and required proposed class/collective members to work off the clock without compensation. Further, the plaintiff says the defendant paid its Annapolis workers at a reduced minimum wage rate of $3.63 per hour without providing the employees with proper notice that a tip credit would be applied to their pay.
