Texas Standard Construction, Ltd. and an individual with control of the business are facing a proposed collective action alleging they misclassified construction work helpers as independent contractors and failed to pay them overtime wages.
Texas Standard Construction, Ltd. and an individual with control of the business are on the receiving end of a proposed collective action alleging they misclassified construction work helpers as independent contractors and failed to pay them overtime wages. The plaintiffs, former employees of the defendants, claim the company unlawfully deducted 30 minutes from their hours each day for the time it took to be driven to and from each job site after clocking in at the defendants’ headquarters. The suit further alleges that they were denied overtime wages because their employers classified them as independent contractors. According to the complaint, the plaintiffs and similarly situated workers should have instead been classified as employees and paid overtime wages due in part to the amount of control the defendants allegedly maintained over all aspects of their job.
