A former delivery worker claims in a lawsuit that Tasty Fast Food Inc. and its owners failed to pay mandatory minimum and overtime wages.

The operating companies behind Tasty Fast Food and the owners of the Forest Hills, New York restaurant are the defendants in a proposed collective action in which the plaintiff claims the parties failed to pay proper wages. The plaintiff claims that although he was employed as a tipped delivery worker, he was required to spend “several hours” each day performing non-delivery-related work around the restaurant. According to the complaint, the plaintiff’s and all other delivery workers’ actual job duties were disguised by the defendants in payroll records to enable the parties to pay the individuals at a lower, tip-credited hourly rate.
The plaintiff, who worked for the defendants from August through December 2016, claims he typically worked up to 62.25 hours per week without proper minimum, overtime or spread-of-hours pay.
