Florida BC Holdings, LLC (which does business as Synergy Equipment) is facing a proposed class action filed by a former employee who claims the defendant refused to pay him proper overtime wages.
Florida BC Holdings, LLC (which does business as Synergy Equipment) is facing a proposed class action filed by a former employee who claims the defendant refused to pay him overtime based on its improper determination that he was exempt from Fair Labor Standards Act (FLSA) requirements. The man alleges he worked for the rental company between March 2016 and September 2017 as a sales coordinator and was paid a salary and commissions for performing more than 40 hours of work per week. During that period, the defendant supposedly reclassified his position as non-exempt and began paying him at the time-and-a-half premium rate for his overtime hours. The complaint argues that even after the plaintiff’s position was reclassified, the defendant continued to violate the FLSA’s overtime requirements by “failing to include all hours worked and failing to pay him at the correct overtime rate.”
