Suntrust Bank is on the receiving end of a lawsuit in which a former employee claims she was deprived of overtime pay as a result of unavoidable off-the-clock work.
Suntrust Bank is on the receiving end of a proposed collective action in which a former employee claims she was deprived of overtime pay as a result of unavoidable off-the-clock work.
The plaintiff worked for the bank as an hourly paid fraud investigator, tasked with investigating potential frauds involving debit cards and checks, from October 2015 to January 2018, the suit says. According to the complaint, the plaintiff was assigned a daily quota of investigations to complete, which the woman says she could not accomplish during her 8-hour workdays. As a result, the case continues, the plaintiff and similarly situated employees ended up working off the clock in order to complete their assignments.
The suit goes on to allege the defendants willfully violated federal labor law, as the plaintiff’s managers were aware that she regularly worked off the clock.
“PLAINTIFF sent emails to DEFENDANT’s management with attachments that showed job activity after the PLAINTIFF’s clock-out time,” the complaint notes.
The suit claims the plaintiff “at various times” worked in excess of 40 hours per week because of her off-the-clock work, but did not receive overtime pay for this time.
