Mastiha Corp. (which does business as Stage Door Deli) and two individual owners are facing a lawsuit filed by a former employee who claims they failed to comply with wage and hour regulations set forth under the Fair Labor Standards Act and New York law.
Mastiha Corp. (which does business as Stage Door Deli) and two individual owners are facing a lawsuit filed by a former employee who claims they failed to comply with wage and hour regulations set forth under the Fair Labor Standards Act and New York law. The plaintiff says he was tasked with preparing food, washing dishes, cleaning, and delivering orders for the defendants from 2008 through March 10, 2017. He claims he regularly worked 60 hours per week but was not paid time-and-a-half overtime wages for the hours he worked beyond 40 each week. Even further, the suit alleges the plaintiff was paid less than minimum wage for the first 40 hours of each week and was denied spread-of-hours wages for each shift he worked that last longer than 10 hours.
Though the defendants allegedly provided wage statements for some weeks the plaintiff worked, the suit says the statements were inaccurate and failed to account of all of his hours.
