Two operating companies of ShopRite grocery stores in New Jersey, along with two individuals, are on the receiving end of a proposed collective action filed by a former employee who claims he was unlawfully misclassified as exempt from overtime pay. The plaintiff allegedly worked at Shoprite as a chef for more than 40 hours per week, but did not receive time-and-a-half overtime compensation for the hours he worked above 40. The suit argues that the plaintiff had no executive or administrative duties and that his position did not fall into any exempt category under the Fair Labor Standards Act. Therefore, the complaint claims, he and similarly situated employees should have been paid overtime wages.
