Rapi Inc. (which does business as Brioso Ristorante in Staten Island) and two individual owners are facing a proposed collective action that claims they failed to pay their employees any wages at all and neglected to provide them with required wage documents. According to the suit, servers, runners, and bartenders were paid only in tips received from customers. On top of that, the defendants supposedly retained portions of employee tips when the cash register was short or when customers paid with credit cards. The plaintiff also says he was never given wage notices at his time of hire or provided with weekly wage statements that recorded his hours and rates of pay.
