A former employee of Arkansas's Department of Human Services (DHS) claims in a proposed class and collective action that she was not paid proper wages. According to the complaint, the DHS operates Dermott Juvenile Treatment Center and Dermott Juvenile Correctional Facility, where the plaintiff split time as a direct care staff member between late February and December 2017. The plaintiff claims she and other employees would regularly work more than 40 hours per week without being paid overtime wages.
Furthermore, the suit argues that the defendants would frequently alter employees’ time records to reflect that they never worked beyond their scheduled shifts and took required 30-minute lunch breaks when employees were often required to work extra hours and were unable to take breaks.
The plaintiff says she was only paid for 40 hours of work during the last nine days of her employment with the defendants despite working more hours than scheduled.
