MC Cable, LLC is facing a proposed class and collective action filed by two former employees who worked for the defendant as technicians and were allegedly misclassified as independent contractors.
MC Cable, LLC is facing a proposed class and collective action filed by two former employees who worked for the defendant as technicians and were allegedly misclassified as independent contractors. The plaintiffs say they were responsible for installing cable lines in residential areas and were required to adhere to strict guidelines, schedules, and locations. They were allegedly not permitted to sub-contract their work or perform work for other companies, which the suit says indicates that they should have been considered employees rather than contractors. The plaintiffs claim they are entitled to Fair Labor Standards Act protections and are owed unpaid overtime wages for all the hours they worked above 40 each week.
The plaintiffs have also filed individual claims against the defendant concerning alleged discrimination based on their Hispanic race. They argue that their employer often disciplined them for “relatively minor issues” while not subjecting non-Hispanic employees to the same treatment. According to the suit, one of the plaintiffs filed a complaint with his manager over the supposed issue, and he and the other plaintiff were allegedly terminated approximately one month later without reason.
