A former sheriff's deputy claims St. Francis County failed to pay overtime even though he routinely worked more than 40 hours each week.
In a proposed collective action, a former St. Francis County, Arkansas law enforcement employee claims the county has failed to pay proper minimum and overtime wages in violation of the Fair Labor Standards Act (FLSA). The plaintiff, who the case says worked as a sheriff’s deputy for the county from November 2013 through October 2017, claims the defendant failed to establish a “work period” for its sheriff’s department. According to the complaint, the plaintiff routinely worked more than 40 hours per week—sometimes in excess of 171 hours over a 28-day period—without being paid for all hours worked. Moreover, the plaintiff claims he was required to phone in his hours each day, but no matter how many hours he verbally reported, his paycheck never exceeded that of a 40-hour workweek.
