A current employee of Patina Restaurant Group, LLC (which does business as The Sea Grill), Raroc, LLC, and Delaware North Companies, Inc. has sued the companies claiming they improperly classified her and others as exempt from overtime wages.

A current employee of Patina Restaurant Group, LLC (which does business as The Sea Grill), Raroc, LLC, and Delaware North Companies, Inc. has sued the companies claiming they improperly classified her and others as exempt from overtime wages. The plaintiff, who is employed at The Sea Grill as a sous chef, says she regularly works more than 40 hours per week but does not receive time-and-a-half overtime wages for all hours she works above 40. She says she does not have the authority to hire or fire employees, does not hold a culinary degree, and essentially performs the same duties as non-exempt kitchen workers, which she claims are all duties of a non-exempt employee entitled to overtime pay.
The case further argues that the defendants owe the plaintiff and similarly situated employees spread-of-hours wages for any shifts they worked lasting longer than 10 hours in a day and wage documents detailing their hours and pay rates.
