Smurfit Kappa is facing a proposed class action lawsuit accusing the company of failing to pay employees proper overtime wages and requiring them to work through meal and rest breaks.

Smurfit Kappa Orange County LLC and Smurfit Kappa North America LLC are on the receiving end of a proposed class action lawsuit alleging federal and state labor law violations. According to the complaint, the defendants failed to pay their non-exempt employees proper overtime wages and required them to work through meal and rest breaks without compensating them an extra hour of pay for each missed break. Further, the lawsuit claims the defendants didn’t provide employees with accurate wage statements and never reimbursed them for spending their own funds on “necessary business-related expenses and costs.”
The case was originally filed in state court and has recently been removed to the U.S. District Court for the Central District of California.
