Smith Turf & Irrigation and three individuals with control of the business are facing a lawsuit that cites claims of unpaid overtime wages.
Smith Turf & Irrigation, LLC and three individuals with control of the business have been named as defendants in a proposed collective action that cites claims of unpaid overtime wages.
The allegations come from three outside technicians who are responsible for diagnosing and repairing mowing equipment and irrigation systems and who claim they were improperly paid at a straight-time rate for hours worked in excess of 40 each week. The case argues that the defendants maintained “operational control and supervising authority” over the workers, indicating they are non-exempt employees entitled to time-and-a-half overtime pay under the Fair Labor Standards Act (FLSA).
