Two Arizona consumers have filed a proposed collective action against SimonMed Imaging Incorporated claiming the company denied them required overtime wages by misclassifying them as exempt employees.
Two Arizona consumers have filed a proposed collective action against SimonMed Imaging Incorporated claiming the company denied them required overtime wages by misclassifying them as exempt employees. According to the suit, the plaintiffs worked for the defendant as a modality service engineer and an MRI field engineer, performing mostly manual labor. The complaint argues that they both worked more than 40 hours per week and should have qualified for time-and-a-half overtime wages for the hours they worked above 40 each week. They say the defendant unlawfully claimed they were exempt from overtime requirements under the Fair Labor Standards Act and denied paying them any overtime wages.
