Osaka Steakhouse & Sushi, Inc. has been hit with a proposed class and collective action filed over alleged state and federal labor law violations.
Osaka Steakhouse & Sushi, Inc. and four individuals with control of the business have been hit with a proposed class and collective action filed over alleged state and federal labor law violations. Filed by two former cooks who worked at the defendants’ SHU Chinese Restaurant, the lawsuit alleges the parties failed to pay their employees proper minimum, overtime, and spread-of-hours wages. The plaintiffs say they worked at least 66 hours per week and were provided with fixed monthly salaries that, when divided by their hours worked, failed to meet the minimum hourly rate. Moreover, the plaintiffs say they did not receive time-and-a-half overtime pay for hours worked over 40 each week, nor spread-of-hours wages for working more than 10 hours each day.
The case additionally claims the defendants failed to provide employees wage notices upon their time of hire and accurate wage statements for each pay period.
