According to the suit, the plaintiff was paid a fixed rate of $465 for the 59.5 hours he clocked each week. The plaintiff alleges he did not, however, receive time-and-a-half overtime pay for time worked in excess of 40 hours each week. In addition, the suit says the defendants failed to meet federal law’s tip credit requirements by neglecting to notify the worker that a tip credit would be used to offset his hourly wages, meaning the restaurant was obligated to pay him at least the full minimum wage. The plaintiff’s reduced hourly rate was also inappropriate due to his mandatory participation in an invalid tip pool that consisted of both tipped and non-tipped employees, including the restaurant’s manager who supposedly pocketed about $100 of tips received on take-out orders each week, the case says.
