The operating company of Prospects Sports Bar and Grill and three individual owners are facing a proposed collective action filed by three servers and a chef who claim they did not receive proper wages.

The operating company of Prospects Sports Bar and Grill and three individual owners are facing a proposed collective action filed by three servers and a chef who claim they did not receive proper wages during their employment with the defendants. The server plaintiffs say they were paid $2.63 per hour plus tips, but were required to contribute to a tip pool. The suit argues that the tip pool was illegal under the Fair Labor Standards Act because it was distributed to non-tipped employees such as bussers and chefs and was sometimes kept by the defendants.
One plaintiff further claims that she worked as a chef at the defendants’ restaurant for more than 40 hours per week without receiving proper time-and-a-half overtime wages.
