A former employee claims Septic 2010 failed to include commissions when calculating sales reps' hourly overtime rates.
Deerfield Beach, Florida’s Septic 2010 LLC and its owner are the defendants in a proposed class action over supposed Fair Labor Standards Act (FLSA) violations. The plaintiff alleges that he worked more than 40 hours per week during numerous weeks between September 2014 and June 2017 without being paid mandatory time-and-a-half overtime. More specifically, the lawsuit claims the defendants failed to include the plaintiff’s commissions when calculating his and other sales representatives’ hourly overtime rates. The complaint says the plaintiff worked between 50 and 60 hours per week without rightful pay.
