SC Maintenance Facing Unpaid Overtime Claims in Wage and Hour Suit

A lawsuit claims that SC Maintenance Inc. wrongly classified all laborers as exempt from overtime wages “regardless of their job duties or any individualized variances.”
A proposed collective action out of Florida federal court claims that SC Maintenance Inc. and the company’s owner wrongly classified all laborers as exempt from overtime wages “regardless of their job duties or any individualized variances.”
Behind the suit is an individual who says he routinely worked 12- to 16-hour shifts as a floor technician for a flat sum of $100 per day.
“Plaintiffs [sic] routine shift was from 7:00pm until about 7:00 am and later, and then, after completing the work at the store, Plaintiff was required to drive back to the Defendants’ home and office before being dismissed for the day,” the suit explains.
The plaintiff alleges the defendants “absolutely knew” that he and other floor technicians were working more than 40 hours per week, but “failed and refused” to properly pay them for overtime work.
