Santa Anna, LLC and an individual owner are on the receiving end of a proposed class action lawsuit that claims they failed to pay their employees proper minimum and overtime wages.
Santa Anna, LLC and an individual owner are on the receiving end of a proposed class action lawsuit that claims they failed to pay their employees proper minimum and overtime wages. According to the suit, the plaintiff worked at the defendants’ restaurant as a tipped hourly paid employee, but was not paid proper overtime wages for any hours she worked above 40 in a week. She further argues that the defendants were not eligible to apply a tip credit to her wages because they set aside portions of the tip pool for bussers, hostesses and other employees “that were never actually paid to said employees.” As a result, the complaint claims, the defendants must pay the plaintiff the full minimum wage for each hour she worked.
