Infusion Software, Inc. (which does business as InfusionSoft), five executives, and their spouses have been named as defendants in a proposed collective action filed by former sales employees who claim they should have been paid overtime wages. The plaintiffs in the case say they were employed by InfusionSoft in several different sales positions and were often required to work between 55 and 70 hours per week in order to meet their quotas. On top of that, the complaint claims sales employees were asked to be available outside regular business hours to communicate with customers in other parts of the world.
Despite these requirements, the plaintiffs say the defendant failed to pay them time-and-a-half overtime wages and neglected to accurately record their hours, since the number of hours worked allegedly “had no impact on total compensation.”
