Rodriguez Auto Transport Corp. and an individual with control over the business are the defendants in a lawsuit filed by a former maintenance employee who claims he regularly worked 80.5 hours per week without time-and-a-half overtime pay.
Rodriguez Auto Transport Corp. and an individual with control over the business are the defendants in a lawsuit filed by a former maintenance employee who claims he regularly worked 80.5 hours per week without time-and-a-half overtime pay. The lawsuit says the plaintiff, who worked for the interstate vehicle transportation company from December 2014 through April 2016, was paid a flat $700 rate per week that did not vary based on the number of hours worked. During a stretch of 46 weeks during his employment, the plaintiff allegedly received no wages at either his regular or overtime rate, the complaint states.
“[The plaintiff] complained many times with the owner/manager … about the unpaid regular wages and overtime hours, but [the defendants] gave [the plaintiff] different excuses and ignored his requests,” the case claims.
Further, the plaintiff claims that after severing his employment with the defendants, he was not allowed to pick up his personal tools from the company’s premises.
