A proposed class action lawsuit filed on the last day of August claims 24-hour care provider River Manor Corp., which does business as the Atrium Center for Rehabilitation and Nursing in Brooklyn, New York, and the below defendants failed to pay licensed practical nurses proper wages:
- River Manor Care Center, Inc.;
- Excelsior Care Group, LLC;
- River Manor Acquisition I, LLC;
- River Manor Acquisition II, LLC; and
- The above entities’ two individual owners.
The plaintiff, who the case says worked at the 380-bed, seven-floor Atrium Center from around 2004 through March 2016, claims he and other licensed practical nurses were required to work past their scheduled shift end times without compensation for these hours “in plain view of [the defendants’] management.” Moreover, the plaintiff alleges one hour is automatically deducted from proposed collective members’ pay even though licensed practical nurses usually do not have time to take this break due to their job responsibilities. All told, the plaintiff argues he and other current and former licensed practical nurses are owed unpaid time-and-a-half overtime for all hours worked over 40 dating back to August 31, 2011.
