Restaurant Owners, Operators of 110 Japan Named in Unpaid Overtime Case

A hibachi chef and cook formerly employed by Huntington Station, NY restaurant 110 Japan claim they and others are owed unpaid overtime wages.
Two named plaintiffs allege Blue Pacific, Inc., which operates as Huntington Station, New York Japanese restaurant 110 Japan, and nine individuals with control of the business violated federal and state labor laws by failing to pay proper overtime. One plaintiff, who worked as a Hibachi chef for the defendants, claims he worked between 48.5 and 57.75 hours per week (depending on how many days he was scheduled to work in a given week) and occasionally drove employees to the restaurant without receiving proper wages. According to the complaint, he was paid a fixed daily rate in both cash and by check regardless of how many hours he worked per week. Further, the case claims the defendant unlawfully deducted between $40 and $50 in tips from the Hibachi chef plaintiff each week.
The second plaintiff claims that in addition to the roughly 59 hours he spent per week cooking, he was also tasked with driving employees to and from work. In total, the case claims the cook plaintiff worked 70 hours per week without being paid proper wages.
