Hernandez v. Ramirez Services LLC et al.
Filed: October 17, 2017 ◆§ 1:17-cv-04131-AT
A fmr. laborer's lawsuit against Ramirez Services LLC claims the company paid workers a flat rate - without overtime - regardless of how many hours worked.
A proposed collective action filed in Georgia alleges Ramirez Services LLC illegally paid its construction workers at a straight-time rate for all hours worked, in violation of the Fair Labor Standards Act’s overtime regulations. The plaintiff, a former laborer for the defendant, claims that during his 30 weeks working for the Athens-headquartered company, he put in 50 hours per week and was paid a flat rate of $800 for all hours worked. The complaint pegs the total unpaid overtime allegedly owed to the plaintiff at more than $6,000.
