A Brooklyn resident has filed a proposed collective action in which he claims his former employer, Queens eatery Jing Wah Chinese Restaurant, and its owners failed to pay proper minimum, overtime and spread-of-hours wages.
A Brooklyn resident has filed a proposed collective action in which he claims his former employer, Queens eatery Jing Wah Chinese Restaurant, and its owners failed to pay proper minimum, overtime and spread-of-hours wages. The complaint states the plaintiff worked for the defendants as a tipped delivery employee from October 2016 through July 2017. The man was paid $1,500 per month for working 72-hour weeks, the suit says, a salary that did not vary regardless of the number of hours worked.
“As a result, [the plaintiff’s] effective rate of pay was always below the statutory federal and state minimum wages in effect at relevant times,” the complaint asserts.
