A former employee has filed suit against Tribor Management, Inc.; Birchwood Apartments Owners Corp.; CLS Properties Management Inc. and seven individual managers over allegedly unpaid overtime wages.
The plaintiff says he worked as an on-site superintendent at a shareholder-owned apartment cooperative managed by the defendants in Queens, New York, where he was responsible for repairing apartments and responding to tenants’ calls and complaints, among other duties.
According to the suit, the plaintiff generally worked six days per week from 8:00 a.m. to 5:00 p.m. but was “on-call twenty-four hours and seven days each week in order to assist tenants and Defendants with any needs that may arise.” The man claims he responded to an average of seven to eight emergencies each month that lasted one to one-and-a-half hours each, totaling at least 51 hours worked each week without proper overtime compensation.
The case further alleges the man was deprived of a proper wage notice upon being hired and regular paystubs throughout his employment, in violation of state law.
