The plaintiff says he was previously employed as a maintenance supervisor by Blue Rock Properties LLC, which paid him an hourly wage and properly classified him as non-exempt from overtime requirements under the Fair Labor Standards Act. He argues, however, that when the defendants took over management of the properties he worked on, they misclassified him as an exempt employee and refused to pay him overtime wages for the hours he worked above 40 each week. The amount of unpaid overtime hours was significant, according to the complaint, as the plaintiff and other employees were forced to work 60 to 70 hours per week due to understaffing and “major renovations” being performed on the properties.
The plaintiff says the defendants eventually changed their overtime policy after employees complained to management on several occasions, but he says he is still owed unpaid wages for the weeks he was illegally misclassified.
