A former shop mechanic claims Producers Service Corporation 'knowingly and deliberately” failed to pay proper overtime wages.
Producers Service Corporation (PSC) is the defendant in a proposed collective action filed by a former shop mechanic who claims the company “knowingly and deliberately” failed to pay proper overtime wages. The lawsuit, filed in Oklahoma, states the allegedly unpaid overtime stems from the defendant’s failure to include non-discretionary bonuses paid to the plaintiff and other hourly-paid workers in calculating the individuals’ overtime pay rates. From the complaint:
“While PSC actually paid overtime for all hours worked over forty (40) each workweek, PSC did not include the non-discretionary bonuses in calculating Plaintiff and the Putative Class Members’ regular rate of pay as is required by federal law. Therefore, the overtime wages were improperly calculated resulting in the underpayment of overtime wages.”
