Per a lawsuit, Pro Custom Solar failed to pay proper OT and did not reimburse workers for vehicle-related business expenses.
A proposed class action filed in New York State Supreme Court on November 27 and transferred to federal court roughly a month later details wage and hour allegations against Pro Custom Solar LLC. The plaintiff, who worked as a manual laborer for the defendant from March through November 2017, claims the company failed to pay proper overtime wages and subjected workers to unlawful pay deductions for vehicle-related business expenses. The woman says she worked between 70 and 80 hours per week – and sometimes more than six days per week – without proper compensation.
The case notes the plaintiff and members of the proposed class were required to use their own vehicles to make deliveries for the defendant. The plaintiff claims she spent roughly $130 per week on gas, and incurred other work-related costs for her vehicle, without being reimbursed.
