Two former employees of Poppy’s Deli and Ray’s Deli Grill have filed a lawsuit against the eateries' respective operating entities and an individual with control over the businesses that takes issue with the parties’ alleged non-payment of proper wages.
Two former employees of Poppy’s Deli and Ray’s Deli Grill have filed a lawsuit against the eateries' respective operating entities and an individual with control over the businesses that alleges the parties’ non-payment of proper wages violated state and federal labor laws. The plaintiffs – who throughout their employment covered the positions of cook, food preparer, delivery worker, dish washer, sandwich preparer, and cashier – allegedly worked at least 57, and at times up to 89.5, hours per week without receiving proper overtime or spread-of-hours wages. They were both paid in cash, according to the complaint, and were not provided with wage statements that detailed their hours and rates of pay.
One of the plaintiffs claims he was forced to purchase a truck for delivering food and running personal errands for the defendants. The cost of the vehicle was allegedly deducted in $50 installments from his weekly wages and was never refunded when the defendants “took the truck back” after “an altercation.” On top of the truck payments, the suit further argues that the defendants must reimburse the man for gas and parking tickets, as well as work shirts that both he and the other plaintiff supposedly purchased with their own funds.
