Plaintiff Claims Straub Distributing Co. Deducted Wages for Untaken Meal, Rest Breaks

Garcia v. Straub Distributing Company, Ltd.
Filed: December 27, 2017 ◆§ 8:17-cv-02249-JVS-JEM
A fmr. merchandiser claims Straub Distributing Co. took wages from employees' checks for meal and rest breaks that usually went untaken.
Allegedly unpaid wages and withheld meal and rest breaks are at the center of a proposed class action filed against Straub Distributing Company, Ltd. Citing alleged violations of California labor laws, the plaintiff, a merchandiser employed by the defendant from 2008 through 2013, says the defendant failed to provide proposed class members with appropriate meal and rest breaks while regularly deducting wages for such time from employees’ pay. This ties into the lawsuit’s second count, which alleges Straub Distributing has thusly failed to pay proper minimum and time-and-a-half hourly overtime wages.
The complaint further claims the defendant failed to pay workers all wages owed in a timely fashion upon their separation from the company.
