A former employee of Southeastern Pizza Group, LLC has filed suit against the company alleging he and other pizza delivery drivers were not properly reimbursed for expenses associated with driving their own vehicles.
A former employee of Southeastern Pizza Group, LLC has filed suit against the company alleging he and other pizza delivery drivers were not properly reimbursed for expenses associated with driving their own vehicles. The suit seeks to cover hourly paid delivery drivers who worked at one of the defendant’s Pizza Hut restaurants during the past three years.
The plaintiff says he was paid approximately $1 to $1.25 for each delivery as reimbursement for the cost of operating his vehicle, including expenses incurred for maintenance, gasoline, and depreciation. Considering the length of average deliveries, the defendant’s reimbursement rate fell between $0.125 and $0.25 per mile, according to the complaint. The suit notes that the standard IRS reimbursement rate for businesses during the relevant time period varied between $0.535 and $0.575 per mile, well above the defendant’s supposed rate.
As a result of Southeastern Pizza Group’s pay practices, delivery drivers’ wages fell below the federally required minimum wage, the suit says.
