Pizza Hut of Southern Wisconsin, Inc. is facing claims that it violated federal labor law by failing to properly reimburse delivery drivers for the use of their own vehicles. The plaintiff in the case says he worked as a Pizza Hut delivery driver in Wisconsin and was paid $5.00 per hour plus tips. According to the suit, the defendant reimbursed the plaintiff and other delivery drivers between $0.26 and $0.29 per mile for automobile expenses associated with operating their vehicles, including gasoline, insurance, maintenance, and depreciation. The suit argues that the defendant’s reimbursement rate was insufficient to cover these costs and caused the plaintiff’s pay rate to fall below the federal minimum wage.
