A personal care assistant claims New Generation Health Services only pays workers at their straight-time rates for hours worked over 40 each week.
A Georgia woman employed as a personal care assistant by New Generation Health SVCS, Inc. has filed a proposed class action against the home health services company over allegedly unpaid overtime wages. The plaintiff claims she and similarly situated employees routinely work more than 40 hours per week, yet receive only their straight-time pay for this work time, not the time-and-a-half hourly pay required under the Fair Labor Standards Act (FLSA). This straight-time overtime rate is labeled by the defendant as “commissions” on proposed class members’ pay stubs, the lawsuit says.
