According to the complaint, the plaintiff began working for the defendant at various locations in and around Marion County, Florida in January 2016. The case says the plaintiff worked more than 40 hours during multiple weeks between January 2016 and the present without being paid time-and-a-half wages as required by the Fair Labor Standards Act (FLSA). Instead of remitting overtime pay for these hours, the defendant instead paid construction employees at their straight-time rates, the suit claims.
The lawsuit’s second count concerns the allegedly retaliatory manner in which the plaintiff’s employment ended. According to the case, the plaintiff complained to one of the defendant’s managers in June 2018 that he wanted to be paid time-and-a-half wages for overtime hours he previously worked. The case says the plaintiff was terminated on the spot as a direct result of speaking up about his allegedly unpaid overtime hours.
