Customer service call center company Percepta, LLC is staring down a proposed class action over alleged FLSA overtime law violations.
Customer service call center company Percepta, LLC is staring down a proposed class action filed in Florida over alleged Fair Labor Standards Act (FLSA) overtime law violations. The plaintiff, a regional customer service manager who the case says is still employed by the defendant, claims she and other hourly employees are owed unpaid wages for working off-the-clock, as well as time-and-a-half for each hour worked past 40 during certain workweeks.
“Despite the hours worked by [the plaintiff] and all those similarly situated employees, [Percepta] willfully, in bad faith, and in knowing violation of the Federal Fair Labor Standards Act, failed and refused to pay them overtime compensation,” the complaint argues, adding proposed class members were told they “needed to do whatever was needed to get the job done,” including work off the clock.
