Pegasus Research Group, LLC, which operates as Televerde, is the defendant in a class action claiming the business-to-business marketing and sales solutions company violated the Fair Labor Standards Act (FLSA) with its wage practices. Filed in Arizona, the lawsuit alleges the defendant intentionally misclassified individuals working as Inside Marketing and Inside Sales Representatives to avoid paying them FLSA-mandated overtime and minimum wages.
The plaintiffs claim they and class members did not have FLSA-exempt job duties and routinely worked more than 40 hours per week, often through lunch break time, and frequently took their laptops home to complete work while not being paid at the time-and-a-half overtime rate for these hours. Additionally, the plaintiffs were reportedly not allowed to count time spent working on weekends or on company trips as actual time worked.
