Former employees of food service PBG Delivery Dudes claim they were misclassified as independent contractors and deprived of proper wages.
PBG Delivery Dudes LLC and the food delivery service’s owner are on the receiving end of a lawsuit filed by two former employees who claim they were misclassified as independent contractors and deprived of proper wages.
According to the case, the plaintiffs worked as delivery drivers at the company for a pay rate that ranged between 50 cents and two dollars per delivery, plus tips. Drivers typically made six or seven deliveries per eight-hour shift, the suit explains, and often worked between 50 and 60 hours per week, resulting in a pay rate that allegedly fell well below the required minimum rate.
The plaintiffs say the defendants controlled most aspects of their jobs, including their schedules, assignments and uniform policy, meaning the workers should have been designated as true non-exempt employees entitled to proper minimum and overtime pay.
