Panera Bread Company has been accused in a proposed collective action of misclassifying its assistant managers as exempt from overtime wages in violation of federal and state labor laws.
Panera Bread Company has been accused in a proposed collective action of misclassifying its assistant managers as exempt from overtime wages. The two named plaintiffs, who were formerly employed at Panera as assistant managers, claim they often worked between 55 and 60 hours per week without receiving time-and-a-half overtime compensation for the hours they worked above 40. They argue that their job duties were primarily non-managerial and that they often performed the same customer service, cashiering, food preparation, and cleaning duties as non-exempt employees. As a result, the suit alleges, they and other assistant managers should have received overtime wages in accordance with the Fair Labor Standards Act.
